4. How long will it take to deal with my claim?

For most personal injury claims handled by a solicitor the council has 40 days from acknowledgement to investigate and respond with a liability decision (this is 30 days if it is an injury claim from an council employee).  Where a claimant is not represented by a solicitor, Civil Procedure Rules do not require us to respond with a liability decision any sooner than 90 days from our acknowledgement of the claim, although in practice we usually expect to be able to respond much sooner than this.

Where a claim involves loss or damage to a claimant’s personal property, we expect to be able to respond with a liability decision within 28 days from the date we acknowledge the claim.
